State or county highways as declared by law. On and after 1 January 1924, all roads within this state shall be highways which have been or may be declared by law to be state or county highways (W.S. 24-1-101(a)). Other roads are not highways unless lawfully established as such by official authority, with the packed exceptions in that section (federal-public-land access roads; common-law adverse possession or prescription).

Wyoming Department of Transportation (WYDOT), created by W.S. 24-2-101 as a department of transportation consisting of a transportation commission and a director. WYDOT’s Utilities Section regulates utility companies wishing to use WYDOT right of way as a utility corridor. W.S. 1-26-813 requires permission from the state transportation commission (or the county board, on a county road) before a public utility or communications company enters a state highway to construct fixtures.

W.S. 24-1-105(a). State highways may be established not to exceed three hundred (300) feet in width unless a greater width is necessary for parking facilities, maintenance, excavations, embankments, the deposit of waste materials, or driveways for livestock (W.S. 24-1-105(a)). County roads under that chapter: not less than sixty nor more than one hundred feet unless the board of county commissioners determines a less width; livestock driveways not exceeding five hundred feet. This is a width restriction, not a term-of-art definition of “right-of-way.” W.S. 24-1-101’s prescription/adverse-possession language is not a packed width. Do not substitute Florida § 334.03(21).
