ALPR statute

23 V.S.A. § 1607 (and § 1608 preservation) — Automated license plate recognition systems. Packed text is the version marked effective 1 July 2025. A Vermont law-enforcement officer must be certified in ALPR operation by the Vermont Criminal Justice Council to operate a system (§ 1607(a)). Use of ALPR systems and access to active data are restricted to legitimate law enforcement purposes. Active-data access inside a department is limited to designated personnel and to data collected within the past seven days. Historical data go through a VIC analyst; requests within six months need specific and articulable facts tying the data to an ongoing criminal, missing-person, or CMV investigation or enforcement action; after six months, VIC may disclose only by warrant (if no pending charge) or by court order in a pending criminal case. ALPR information gathered by a Vermont LE agency is sent to the Department of Public Safety, which maintains the automated traffic law enforcement storage system. DPS reports annually to the House and Senate Judiciary and Transportation committees. This is not a ROW permit. Definitions of “active data,” “historical data,” and “legitimate law enforcement purpose” are not in the packed July 2025 § 1607 text (they may live elsewhere in subchapter 2) and are not packed. Retention: 18 months after the date obtained, then DPS and any local LE agency with custody shall destroy the data and copies/backups, unless a § 1608 preservation request or disclosure order, or a warrant under Vermont or Federal Rule 41, applies (§ 1607(c)(2))..

Who may apply: Anyone or any corporation wishing to use any part of the highway right-of-way on the State or town system (19 V.S.A. § 1111(a)(1)). For State highways the Agency of Transportation issues; for town highways the municipal legislative body or designee. VTrans Permitting Services reviews commercial and residential permits for all work in Agency-owned ROW, including utility facilities. ALPR-specific permit type not listed.. The Secretary (State) or legislative body (town) may suspend a permit until compliance is obtained, and may physically close a driveway or access point if safety of highway users is or may be affected (§ 1111(g)).. Install process in this state

  1. This is Vermont State highway or town highway under Title 19, not Florida SHS. The Agency owns State highway ROW; towns own town-highway ROW.
  2. 23 V.S.A. § 1607 is a use, access, and retention statute, not the ROW permit. Only a VCJC-certified Vermont law-enforcement officer may operate an ALPR system. Active data: legitimate LE purpose, designated personnel, last seven days. Historical data: VIC (or DMV for CMV), then warrant/court-order after six months.
  3. ALPR information gathered by a Vermont LE agency is sent to DPS for the automated traffic law enforcement storage system. Destroy at 18 months unless § 1608 or a Rule 41 warrant applies.
  4. Work in Agency-owned right-of-way needs a State Highway Access and Work Permit under 19 V.S.A. § 1111 (Section 1111 permit), filed with VTrans Permitting Services. VTrans’ page does not list an ALPR permit type.
  5. Do not copy FDOT EOM 26-01, MnDOT OLPA, UDOT Special Use, or Johnson City, TN contract terms into Vermont. Out-of-state Flock-network access is not resolved by the packed § 1607 text.
