NYSDOT’s Highway Work Permits page states that the New York State Department of Transportation is responsible for the State highway system, and that anyone who plans to do work on any part of that system, its properties, or right-of-way must obtain a highway work permit under Highway Law Article 3, § 52.

NYSTA (Thruway), MTA (including Bridges and Tunnels), and NYC DOT own other systems. Do not merge those owners into this NYSDOT pack.

LPR-01 Application and Agreement to Install & Operate License Plate Reader Equipment for Law Enforcement Purposes Within State Right of Way, plus Highway Work Permit (Highway Law § 52) and Annual Maintenance Permit as required. Who may apply: An authorized representative of a federal, state, or local public law enforcement agency (primary applicant / Permittee). A contractor may be Secondary Applicant under a binding contract with the LEA. Executed municipal resolution required with LPR-01 submissions (NYSDOT municipal-resolution template).. LPR-01 § 9: upon NYSDOT approval the agreement is equated to a non-exclusive conditional and revocable license. NYSDOT may revoke, disrupt, or block use for violation of the agreement, HWP, or AMP. Highway Law § 52: noncompliant or unsafe equipment must be removed at Permittee expense within 30 days of NYSDOT notice.. NYSDOT Other Types page names “License Plate Reader Installations (LPR-01 by Law Enforcement Agencies only).” Form LPR-01 (02/05/25) § 9 says a separate Use and Occupancy permit is not necessary for a State, municipal, or county LEA because LPR-01 itself is the occupancy license. Install process in this state

NYSDOT State highway ROW only. Thruway, NYC streets, and MTA facilities are other owners.

  1. Name the land owner. This pack is NYSDOT State highway ROW under Highway Law § 52. NYSTA Thruway occupancy/work permits, NYC DOT street permits, and MTA / Bridges and Tunnels are separate owners — do not merge them and do not file LPR-01 for their property.
  2. This is not Florida’s General Use Permit, not Minnesota’s OLPA, and not Utah’s ALPRS Special Use Permit.
  3. Law-enforcement agency files NYSDOT Form LPR-01 (02/05/25) for a single location, with an executed municipal resolution (Municipal Resolution Template). Contractor, if any, signs as Secondary Applicant.
  4. LPR-01 is the occupancy license. Separately obtain a Highway Work Permit through PermiTrack for install/removal (PERM 33 type 5d5 or 5d6) and a maintenance HWP or Annual Maintenance Permit. Multiple locations in one region may be grouped on one work permit at NYSDOT’s discretion.
  5. Do not install on NYSDOT traffic-signal poles/mast arms or lighting poles. Existing poles, overhead signs, or bridges need the structure owner’s documented approval; utility poles need a fully executed Attachment Agreement. NYSDOT treats LPR gear as not a “utility” under Highway Law.
  6. Data ownership stays with the LEA. Commercial use is forbidden. Share with overlapping LEAs only on written request tied to a criminal investigation. NYSDOT may audit and may order removal within 30 days under Highway Law § 52.
  7. Records: FOIL (POL art. 6) to the clerk (votes/resolution), purchasing (vendor contract), police (policy/logs), and NYSDOT regional HWP / Office of Right-of-Way (LPR-01 file).
