ALPR statute

N.J.S.A. 52:4CC-1 to 52:4CC-6 (P.L. 2026, c. 4); ALPR sharing is act § 5(b) (compiler: C.52:4CC-5) — Privacy Protection Act — Collection, Use, and Protection of Personal Information (automated license plate recognition sharing). P.L. 2026, c. 4 (A4070, approved 25 March 2026; effective immediately except health-care § 6) creates Title 52 ch. 4CC. Act § 3 defines “automated license plate recognition information” as information or data collected through an ALPR system, and “automated license plate recognition system” as a searchable database from one or more mobile or fixed cameras plus algorithms that convert plate images into computer-readable data. Act § 5(b): a government entity shall not sell, share, or transfer ALPR information concerning the operation of a person’s motor vehicle except (a) to another government entity when permitted by law; (b) pursuant to a valid judicial order or judicial warrant; (c) with the person’s knowing written consent under § 5(c); or (d) to a law-enforcement agency of another jurisdiction for a criminal investigation if that agency certifies the information will not be used for civil immigration enforcement, will not be shared/sold/transferred/made searchable by the receiving agency, and that the receiving agency is bound by New Jersey restrictions and NJSP/Attorney General protocols. Out-of-state sharing agreements are OPRA government records. The Attorney General may bar further sharing with an out-of-state agency that violates those limits. A government entity’s use of a third-party ALPR vendor is not itself a sale/share/transfer if the vendor meets § 5(b)(1) and has the entity’s authorization. § 5(d): unless notice would compromise a criminal investigation, disclose ALPR information under a judicial order/warrant or federal law and notify the person within 90 days. § 5(g): knowing obtain/disclose/use of ALPR information for a purpose not permitted is subject to injunctive relief and civil damages in Superior Court. This is a sharing/consent/notice statute, not a ROW install statute and not a retention clock. Retention: No day-count in packed P.L. 2026, c. 4.
