Highway system

RSA 229:1 defines highways (laid out by statute, deeded to city/town/state, dedicated and accepted, or used for public travel 20 years before 1 Jan 1968). RSA 230 is State Highways. RSA 230:1: NHDOT assumes full control and pays construction, reconstruction, and maintenance of all class I (trunk line) highways, including bridges. Class II/III maintenance split is not packed. This is not Florida’s State Highway System.

ALPR statute

RSA 261:75-b (cross-check RSA 236:130) — Use of Number Plate Scanning Devices Regulated. Use of automated number plate scanning devices (LPRs) is restricted to local, county, and state law-enforcement officers, subject to I–XI. Devices record/check plates only and must not be capable of photographing, recording, or producing images of occupants (I). Agency head authorizes devices and training (II). Device must be registered with the Department of Safety before use (III). Operation is official LE only, and only to identify the plate lists in V (stolen; wanted/missing/endangered; outstanding warrant; suspended/revoked license or registration; suspected criminal/terrorist acts, stolen items/contraband, or motor-vehicle violations; CMV violations; case-specific criminal investigative surveillance; homicides/shootings/major crimes; vehicles in the vicinity of a recent crime). A positive match alone is not reasonable suspicion (VI). RSA 236:130 separately forbids the State and its political subdivisions from engaging in “surveillance” on public ways, with listed exceptions (including specifically authorized by statute). 261:75-b is the statute that authorizes LPR use; it is scheduled for repeal 1 January 2027 (2016, 78:3, II). This is not a ROW permit. Retention: RSA 261:75-b, VIII: records of number plates read shall not be recorded or transmitted anywhere and shall be purged within 3 minutes of capture so they are destroyed and not recoverable, unless an alarm resulted in an arrest, a citation, or protective custody, or identified a vehicle that was the subject of a missing-person or wanted broadcast — in which case that plate’s data may be retained until final court disposition. Captured data obtained for paragraph V purposes shall not be used or shared for any other purpose..
