KRS 189.632 (2026 Ky. Acts ch. 71, § 1; effective 15 July 2026) — Automated license plate reader — Permitted uses — Retention and sharing of data — Written policy — Procedure before performing traffic stop — Permit process. Default: it is unlawful for an individual, entity, or the Commonwealth and its agencies and political subdivisions to use an ALPR except as provided (189.632(2)). Deployment is limited to parking regulation, secured-area access, or promoting public safety / deterring crime / addressing auto theft; to a public agency or law-enforcement agency (or its agents) for law enforcement and listed commercial-vehicle purposes; and to the Transportation Cabinet (or its agents) for tolls, road-fund revenue, and listed commercial-vehicle purposes (189.632(3)). Captured plate data shall not be preserved more than ninety days unless retained for a (3)(b) or (3)(c) purpose, retained by law enforcement as evidence in a criminal or insurance-claim investigation, for redacted training, or for auditing, or made subject to a subpoena duces tecum or preservation-of-evidence notification (189.632(4)(a)). Sale, sharing, access, or transfer is forbidden except to law enforcement (or a contracted third party) for public safety or criminal investigations, on subpoena, to NICB, to insurers and financial institutions under listed conditions with a 1 Jan 2027 notice start, or otherwise in furtherance of (3)(b) and (3)(c). Before deployment a law-enforcement agency must adopt and make public a written policy covering databases, retention/destruction, training, supervisory oversight, access/security, and a 90-day audit (189.632(5)). An officer or dispatcher must visually confirm plate and policy fit before a stop on an alert (189.632(6)). The Transportation Cabinet shall establish a permit process for ALPR systems on highway rights-of-way and shall promulgate administrative regulations under KRS Chapter 13A (189.632(7)). Retention: Ninety days unless a 189.632(4)(a) exception applies (lawful (3)(b)/(3)(c) purpose; LE evidence in a criminal or insurance-claim investigation; redacted training; auditing; subpoena duces tecum or preservation-of-evidence notification).
