State highway system: highways designated by the secretary of transportation under K.S.A. 68-406(a) — they connect county seats and principal cities and market centers, including bridges and culverts thereon. Highways designated under that section are state highways; all other highways outside city limits are county or township roads. Total mileage may not be extended except by act of the legislature.

Except to the extent disclosure is otherwise required by law, a public agency shall not be required to disclose records that contain captured license plate data or that pertain to the location of an automated license plate recognition system (K.S.A. 45-221(a)(55)). “Automated license plate recognition system” means one or more high-speed cameras combined with computer algorithms used to convert images of license plates into computer readable data (45-217(a)). “Captured license plate data” means the global positioning device coordinates, date and time, photograph, license plate number and any other data captured by or derived from an automated license plate recognition system (45-217(c)). 45-217(a)/(c) and 45-221(a)(55) were added by L. 2022, ch. 48 (2022 SB 434), effective 1 July 2022. (a)(55) is a KORA “shall not be required to disclose” exemption, not a mandatory confidentiality rule and not a use or retention statute.

What is enacted is a KORA exemption: K.S.A. 45-217(a) and (c) define “automated license plate recognition system” and “captured license plate data”; K.S.A. 45-221(a)(55) (L. 2022, ch. 48 / 2022 SB 434, eff. 1 July 2022) says a public agency shall not be required to disclose records that contain captured license plate data or that pertain to the location of an ALPR system. That is a disclosure exemption, not a use/retention mandate and not a KDOT ROW permit. NYU Policing Project ALPR Scorecard (alprscorecard.com) lists Kansas as “No ALPR statute.” NCSL’s 2022 use-or-retention list does not include Kansas. 2021 SB 305 (policy/retention bill) died in committee and is not packed as law.
