625 ILCS 5/2-130; 605 ILCS 140/ — ALPR user prohibitions; Tamara Clayton Expressway Camera Act. 625 ILCS 5/2-130 (P.A. 103-540, eff. 1 Jan 2024): an ALPR user shall not sell, share, allow access to, or transfer ALPR information to any state or local jurisdiction to investigate or enforce a law that denies or interferes with lawful health care (including reproductive health) or that permits detention or investigation based on immigration status. Sharing with an out-of-state LE agency requires a written declaration that the recipient will not use the data in those ways. ALPR information shall be held confidentially to the fullest extent permitted by law. 605 ILCS 140 (Expressway Camera Act / Tamara Clayton Act, scheduled to repeal 1 July 2028): ISP, IDOT, and ISTHA shall work together to increase cameras along listed-county expressways/State highway system and DuSable Lake Shore Drive. Images, including license plates, may be used by LE with jurisdiction for vehicular hijacking, aggravated vehicular hijacking, terrorism, motor vehicle theft, or a forcible felony (including firearm offenses); to detect expressway hazards and highway conditions; and to facilitate highway safety and incident management — not petty offenses unless the use pertains to expressway/highway safety or hazards. Images exported through a law enforcement database shall be deleted from that database within 120 days unless relevant to an ongoing investigation or pending criminal trial. Retention: Expressway Camera Act: 120 days for images exported through a law enforcement database unless ongoing investigation or pending criminal trial (605 ILCS 140/5(b)). ISP’s transparency page separately states Vehicle Manager storage of ALPR reads for 90 days — that is ISP’s platform statement, not a substitute for the 120-day statutory export-deletion rule. § 2-130 does not name a retention period..
