HRS § 264-1(a): all highways, roads, alleys, streets, ways, lanes, bikeways, bridges, and other real-property highway-related interests opened, laid out, subdivided, consolidated, acquired, and built by the government are public highways. Public highways are of two types: (1) State highways — lands, interests, or other real-property rights with an alignment or highway-related interest established by law, subdivided and acquired under Department of Transportation procedures, and all those under the jurisdiction of the department of transportation; (2) County highways — all other public highways. This is Hawaii’s state-highway classification, not Florida’s State Highway System.

HRS § 264-1(a)(1) vests state highways in the department of transportation. § 264-6: no person or government agency (federal, state, or county) may disturb state-highway right-of-way or place any structure, vehicle, equipment, or other object in that ROW without a written permit from the director of transportation or the director’s authorized representative.
