Highway system: State highway right-of-way under the Colorado Department of Transportation (CDOT). County roads and city streets are not CDOT ROW. Colo. Rev. Stat. § 43-2-101 (state highway system) is not packed in this build.

A custodian shall not require a requester to provide identification to request or inspect records except as otherwise required by § 24-72-204(3.5)(g) or when the record is confidential and accessible only as the person in interest (§ 24-72-203(1)(a)). ALPR statute: No Colorado statute that expressly names ALPRs or captured plate data was packed. C.R.S. § 24-72-113 (2026 compiled Title 24) is a passive-surveillance destruction rule (digital video, photo radar, other image-recording devices used routinely, including traffic monitoring). It does not say ALPR, license plate, or captured plate data. Destroy after three years unless the section authorizes longer retention; access after year one only for a filed claim or an accident, crash, or other specific incident that may make the record evidence. Not the CDOT permit, and not an ALPR-named statute.
ROW permit: Utility/Special Use Permit for Automated License Plate Reader Systems (freestanding installations in CDOT ROW). Who may apply: A Colorado law enforcement agency. CDOT’s procedures page and the October 2023 procedures PDF both say the applicant must be a Colorado law enforcement agency.. If the applicant fails to comply with the procedures and CDOT’s terms and conditions, the permit and any current permits issued to that applicant by CDOT terminate (October 2023 procedures PDF).. This is not Florida’s General Use Permit, not Minnesota’s OLPA, and not Utah’s ALPRS Special Use Permit. CDOT’s instrument is a Utility/Special Use Permit after CSP-ISS signs an ALPR Evaluation and Checklist.

Install process in this state

This is CDOT state-highway ROW, not Florida’s State Highway System. Do not import FAC 14-20.010 or FDOT EOM 26-01. Do not copy Minnesota OLPA or Utah Special Use.
Applicants for installation or maintenance of ALPRs in CDOT ROW must be a Colorado law enforcement agency (CDOT Utility & Special Use Program page).
Step 1 — CSP review: complete the CSP ALPR Evaluation and Checklist and obtain signature approval from the Colorado State Patrol Investigative Services Section (CSP-ISS) before applying to CDOT.
Step 2 — sign CDOT’s Terms and Conditions of Automated License Plate Reader Permits.
Step 3 — a Colorado law enforcement agency submits a Special Use/Utility Permit application through CDOT’s Utility/Special Use process, attaching the signed CSP checklist and the signed Terms and Conditions. Maintenance is a separate Special Use/Utility application (Step 4 in the October 2023 procedures).
§ 24-72-113 is a passive-surveillance destruction rule (2026 compiled Title 24). It does not name ALPR or captured plate data. It is not the permit. Do not treat a three-year cap as a CDOT install condition unless CDOT’s own terms say so — they were not packed as a retention number.
