Right-of-way: not packed. Arizona’s statutory ROW definition is not packed in this build. Do not substitute Florida § 334.03(21). ADOT’s broadband Rights of Way page states that ADOT only owns a portion of the R/W in fee; the remainder is owned by underlying landowners including BLM, USFS, ASLD, Tribal Nations, private landowners, and others. Permission is required from the underlying landowner for any encroachment permit.

Who may request: Public records and other matters in the custody of any officer shall be open to inspection by any person at all times during office hours (A.R.S. § 39-121). Any person may request to examine or be furnished copies, printouts or photographs of any public record during regular office hours, or may request that the custodian mail a copy of any public record not otherwise available on the public body’s website (§ 39-121.01(D)(1)). At the time of the request, the requesting person shall affirm that the record is not for a commercial purpose or, if it is, shall provide a statement of intended use under § 39-121.03(A).
