ALPR statute

Ark. Code §§ 12-12-1801 to 12-12-1808, as amended by Act 668 of 2025 — Automatic License Plate Reader System Act. Default: it is unlawful for an individual, partnership, corporation, LLC, association, or the State of Arkansas, its agencies, and political subdivisions to use an automatic license plate reader system (Act 668 enrolled, amending § 12-12-1803(a)). Exceptions in enrolled § 1803(b): (1) state, county, or municipal law enforcement for comparison of captured plate data with Office of Motor Vehicle, Arkansas Crime Information Center, NCIC, a database created by LE for an ongoing investigation, and the FBI for any lawful purpose; (2) parking-enforcement entities regulating parking facilities; (3) controlling access to secured areas; (4) a private landowner, private leaseholder, or commercial business — defined in Act 668 § 1 as one that is not a governmental entity — for promoting public safety, deterring crime, and monitoring access to that private property, including ingress and egress on a private road; (5) Arkansas Highway Police of ARDOT, installed at an entrance ramp at a weigh station, for electronic verification of registration, logs, and other compliance data on commercial vehicles. Enrolled § 1804: captured plate data shall not be preserved more than 60 days by a private landowner/leaseholder/commercial business, or 150 days by all other eligible entities, except LE data under (b)(1) retained as part of an ongoing investigation and destroyed at the conclusion of an investigation that files no charges or of any criminal action. Governmental users shall not sell, trade, or exchange captured plate data except that LE may share data indicating evidence of an offense with other LE agencies. A governmental entity may compel release from parking, secure-area, or private users only by valid subpoena. Act 668 (SB446; enrolled PDF from arkleg; approved 16 Apr 2025) amends §§ 12-12-1802 through 12-12-1805 and adds Attorney General enforcement of the subchapter under the Deceptive Trade Practices Act (§ 4-88-101 et seq.) as new § 12-12-1807(c). Retention: 60 days (private landowner / leaseholder / commercial business); 150 days (other eligible entities); LE ongoing-investigation data until the investigation ends without charges or the criminal action concludes (Act 668 enrolled § 12-12-1804).
